1. Introduction

Flyer Pocket (the "App") is an application that helps you read the content of school papers (newsletters, flyers, and handouts) sent by daycares, kindergartens, elementary schools, and similar institutions, and manage the schedules and supplies they describe. By using the App, you are deemed to have agreed to these Terms of Service. The App is operated by First Penguin LLC. (the "Operator").

2. Services Provided

• Capturing photos of school papers and reviewing their content
• Extracting and managing schedules and supplies
• Sharing schedules within your family
• Answering questions about the content of school papers (chat feature)

3. Account

You can create an account in the App using any of the following methods.

• Sign up with an email address and password
• Sign up with an Apple ID or Google account
• Anonymous sign-in (for trial use)

4. Conditions of Use

• The App is intended for personal use.
• If you are under 18 years of age, please use the App with the consent of a parent or legal guardian.

5. About the Reading Results

The content of school papers reviewed and extracted by the App (such as schedules and supplies) is provided for reference only. We do not fully guarantee the accuracy of the results. For important schedules or supplies, we recommend that you also check the original school paper.

6. User Responsibilities

• Users are responsible for ensuring that the school papers they upload are lawful and that the privacy of others is respected.
• Please be especially considerate when capturing school papers that include personal information about other children or families.

7. Intellectual Property

The intellectual property rights in the App, including its design, logo, and software, belong to the Operator. The rights to the school paper images and data uploaded by users remain with the users.

8. Subscription

The App offers a Free plan and a Premium plan.

• The Premium plan is an auto-renewing subscription and is governed by the billing terms of the Apple App Store or Google Play.
• Unless cancelled at least 24 hours before the renewal date, the subscription will be renewed automatically.
• Refunds are handled in accordance with the terms of the Apple App Store or Google Play.

9. Prohibited Conduct

• Misusing, reverse engineering, or disassembling the App
• Excessive access to our servers or unauthorised use of our APIs
• Impersonating other users or engaging in nuisance behaviour
• Acts that violate laws, regulations, or public order and morals

10. Disclaimer

• The App is provided "as is". The service may be temporarily interrupted or suspended.
• The Operator is not liable for data loss beyond a reasonable scope.
• The accuracy of the school paper reading results depends on the quality of the images and the content of the school paper.

11. Limitation of Liability

The Operator's liability is limited to direct damages, and the maximum amount of such liability is capped at the total subscription fees paid by the user during the three (3) months preceding the event giving rise to the liability.

12. Changes to These Terms

The Operator may change these Terms of Service without prior notice as needed. The amended terms will take effect when posted in the App or on our website. By continuing to use the App after the change, you are deemed to have agreed to the amended terms.

13. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of Japan. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
